9. Governing Law and Jurisdiction

These Terms of Service and any dispute or claim arising out of or related to them, their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the laws of the state in which Anthony's Coal Fired Pizza is primarily domiciled, without giving effect to any choice or conflict of law provision or rule.

10. Dispute Resolution

The arbitration shall be conducted in the English language, and the arbitrator's decision shall be final and binding on both parties. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

10.3 Class Action Waiver

YOU AND ANTHONY'S COAL FIRED PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and Anthony's Coal Fired Pizza agree otherwise, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

10.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights. Small claims court actions may also be brought in lieu of arbitration if the claim qualifies under applicable small claims court rules.

11. Term and Termination

These Terms of Service are effective as of the date you first access or use the Site and shall remain in full force and effect for as long as you continue to access or use the Site or our services.

11.1 Termination by You
